Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Sixpence protocol smart contracts, the sixpence.xyz website, any associated interfaces, APIs, and related tooling (collectively, the “Services”). By connecting a wallet, signing a transaction, or otherwise using the Services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not access or use the Services.

All information provided through the Services — including market data, interest rates, health factors, and yield figures — is for informational purposes only. Nothing on the Services constitutes financial, investment, legal, tax, or other professional advice. You are solely responsible for evaluating whether any transaction is appropriate for you, and you should consult qualified professionals where appropriate.

You represent and warrant that:

• You are at least 18 years old and have the legal capacity to enter into these Terms;
• You are not a resident of, located in, or accessing the Services from a Prohibited Jurisdiction (see Section 4);
• You are not subject to any sanctions list maintained by the United States, the United Kingdom, the European Union, or the United Nations;
• Your use of the Services will comply with all applicable laws and regulations in the jurisdictions from which you access them.

The Services are not offered to, and may not be used by, persons located in jurisdictions where access is prohibited by law, sanctioned, or otherwise restricted. This list is not exhaustive and may be updated from time to time. You are responsible for determining whether your use of the Services is permitted in your jurisdiction.

The Sixpence protocol is deployed as a set of smart contracts on public blockchains. You understand and accept that:

• Smart contracts may contain bugs, economic design flaws, or vulnerabilities that could lead to partial or total loss of deposited assets, even where audits have been performed;
• Collateral prices are supplied by off-chain oracles whose failure or manipulation may result in liquidations or other adverse outcomes;
• The tokenized equities used as collateral depend on their issuers (such as Ondo, Backed, or xStocks) and on the legal and custodial arrangements backing those tokens;
• Transactions on public blockchains are irreversible once confirmed; mistakes in addresses or transaction parameters generally cannot be undone.

You are solely responsible for the security of your wallet, private keys, seed phrases, and any devices used to access the Services. Sixpence does not custody your assets, hold your keys, or have the ability to reverse or recover lost transactions. Any losses arising from lost keys, compromised devices, phishing, or user error are your responsibility.

The Sixpence name, logo, website design, and interface content are protected intellectual property. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works from the Services except as expressly permitted.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Sixpence does not guarantee that the Services will be secure, error-free, or continuously available.

To the maximum extent permitted by law, Sixpence and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or digital assets, arising out of or in connection with your use of the Services.

You agree to indemnify and hold harmless Sixpence, its contributors, and their affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party right.

Sixpence may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page. Your continued use of the Services after any update constitutes your acceptance of the revised Terms.
